Enrollment Agreement

To ensure that Musicians For Hire, LLC (“MFH”) students receive the most comprehensive and well-rounded music education, adult students and parents of minor students (“Parents”) are required to agree to this Enrollment Agreement. In order to begin private music instruction, execution of this Agreement is required. Adult students and Parents should respectfully contact us during their enrollment if questions arise regarding our Enrollment Agreement. We are here to help students and Parents make the most out of their private music education. Adult students and Parents should reference this page throughout their enrollment.


Private and Group Music Lessons (Online)


Each private lesson is designed for only one (1) student.  If you wish to enroll multiple students in your family for individual private lessons, you may be eligible for a discounted lesson rate (see below).  However, for the most productive private lesson learning environment, we ask that only one student at a time be present during each scheduled private lesson time, unless otherwise agreed to by MFH. Multiple students may be present during the same group music lesson. 


The MFH instructor(s) and adult student or Parent will schedule the lesson times, to be scheduled on a recurring, regular basis, unless otherwise agreed to by MFH. Schedule your lessons carefully. There are no refunds, credits, make-up lessons or re-scheduling unless such lesson is cancelled with at least 24 hours of written notice to the student’s instructor by electronic mail or unless otherwise expressly set forth herein. 


Lessons will be held, electronically, through video transmission software.  The student’s instructor will call the student at the scheduled lesson time at the number provided by the student.  If the student does not answer promptly, a second attempt will be made within a five-minute window from the scheduled lesson time.  If the second attempt is not answered by the student, the student will be deemed absent from the lesson and charged for such lesson unless sufficient advance, written notice was provided to the instructor. 


Cancellation and Suspension of Music Lessons


Cancellation


In the event that a student wishes to cancel a private lesson, the student or Parent must provide MFH with at least 24 hours of advance, written notice, sent to the instructor by electronic mail.  In the case of a one-time cancellation, such lesson may be made up at an agreed to time within two (2) calendar weeks of when the cancelled lesson was to originally take place; provided, however, that in the event that a lesson was missed by the student with no advance notice, such lesson shall not be rescheduled unless such lesson was missed as a result of a family emergency, as documented by the student, or as otherwise excused hereunder. 

Frequent cancellations may result in the loss of the scheduled, recurring lesson time, in the discretion of MFH. 


Suspension

In the event that a student wishes to take an extended leave from or wishes to indefinitely suspend musical instruction with MFH, the adult student or Parent must provide MFH with, at least, two (2) calendar weeks of advance, written notice, before such suspension is to commence. 


Lesson Pricing


Each private 30 minute lesson = $35.00 

Each private 45 minute lesson = $45.00

Each private 60 minute lesson = $60.00


Each group class = $20.00


Lessons are to be paid for monthly, in advance. Once payment is received, but only once payment is received by MFH for a full month of lessons, a student’s recurring lesson time will be reserved by MFH.  Payment for the following month’s lessons must be received by MFH on or before the final business day of the prior month to reserve a lesson time. No lesson will be given until payment is received by MFH.


A one-time registration fee of $50.00 is due with the student’s first monthly lesson payment. 


Students may also schedule lessons on a one-time basis or a semester basis. A 10% discount is offered when scheduling lessons on a semester basis. 


Families who enroll two or more students, will receive a 10% discount on all lesson pricing for as long as multiple students are enrolled. 


Curricular Materials, Books & Sheet Music


Students may receive or be asked to obtain instructional materials – sheet music, instructional method books, flashcards, books w/CD, etc… – as needed based upon the student’s musical progress, based on the instructor’s and/or MFH’s discretion. Such materials may be purchased by the student independently, if available in the marketplace, or may be supplied by MFH at MFH pricing.  Any and all such materials purchase by MFH must be paid for, in full, prior to lesson usage.  Instructional books and music are necessary for comprehensive instruction.


Credit Card Payment and Auto-Pay


Students have the option of enrolling in credit card auto-pay with MFH.  If the student or Parent elects to enroll in auto-pay, the student or Parent must supply MFH with his/her credit card information and complete the credit card charge authorization form, which provides MFH with permission to automatically charge the student’s or parent’s credit card when a payment becomes due, without notice from MFH.  Students may un-enroll at any time from auto-pay by providing at least ten (10) days of written notice to MFH of such election to un-enroll. 


For any and all chargebacks or disputed credit card charges initiated with your credit card company, a $75 administrative fee will be added to your account, plus the original amount disputed, with applicable interest, late fees and reasonable administrative and attorney costs, regardless if your enrollment is current or discontinued. If you believe your credit card charges to be inaccurate or incorrect, it’s recommended and appropriate to contact MFH prior to disputing your credit card charge(s) with your credit card company. Credit Card Chargebacks/Disputes do great harm to a complaint and legitimate small business.


Bounced Check Fees


A $35 NSF fee will be charged for any bounced/returned checks. MFH reserves the right to cancel and/or discontinue private music lessons of any student whose account is past due.


Adult Student & Parent Change of Contact Information


It is the responsibility of the student or Parent to inform MFH of any changes to address, contact person(s), email address or other information such as updated credit card information for auto bill-pay. MFH is not responsible for not having the student/parent’s current contact information.


Teacher Absences, Power & Internet Outages & Technical Difficulties


If a teacher is absent on your scheduled lesson day, a make-up lesson may be offered to you based upon the teacher’s availability or a substitute teacher may be provided at MFH’s sole discretion. Due to the nature of electronically transmitted instruction, no tuition credits or refunds will be issued for private lessons missed due to inclement weather, unless the student’s or instructor’s power or Internet was lost during such event. In the event that computer or Internet interruptions occur during a student’s lesson due to a power outage, the instructor will attempt to call the student back to resume such lesson.  If it is not possible to continue the scheduled lesson at that time, the instructor will attempt to make up the missed portion of the lesson at another time.  The make-up lesson could take place during a separate call or added onto the student’s next regularly scheduled lesson, whichever most convenient and agreed to by the student and the instructor. 

MFH reserves the right to cancel or reschedule lesson, as well as change teacher(s), provide substitute teacher/instructor(s) at MFH’s sole discretion. Student/Parent may be notified of any such change(s).


Emails


We are not responsible for adult students or parents/guardians not receiving or not reading our emails. Please ensure that the following email address: notefish.lesssons@gmail.com is not marked as spam, junk or bulk messages in your email system(s). If you unsubscribe from our email system and want to continue receiving our emails, adult student or parent must re-subscribe on our website. Unsubscribing or marking our direct emails as “junk” or “spam” will result in missing information, deadlines, reminders, etc.


Discontinuation by MFH


MFH reserves the right to discontinue any student’s enrollment – for unreadiness, behavioral problems, verbal and/or written harassment, threatening remarks to instructors, noncompliance with MFH policies and procedures, teacher safety concerns, etc… at MFH’s sole discretion. Unused tuition may or may not be refunded to the adult student/parent, solely based upon MFH’s discretion and the severity of the situation.


Online Lessons


Instruction will be provided to the MFH student, by way of electronic transmission through Zoom or other video transmission software.  Neither student-side nor instructor-side video will be recorded or retained by MFH, in any manner.  


Students are required to have the following in place prior to their first lesson:

A tuned and playable piano or electronic keyboard

A computer, tablet or other electronic device capable of capturing and displaying audio and video simultaneously and a live and reliable Internet connection

Skype chat software already installed and operating 

Electronic device must be directed towards the student’s hand’s and piano keys during the lesson.


Students, or parents of minor students, shall have sole responsibility and liability related to the assent to and compliance with the terms and conditions of any video transmission software used by MFH and the student and all costs and fees for securing the equipment, software and maintaining Internet connection. 


Parental Oversight


MFH asks parents of minor students to be present, at all times, during lessons and while the video transmission software is active for purposes of MFH lessons.  This may be especially helpful for younger student or students who may need help staying on task during the lesson.  In the event that a parent is not present in the nearby vicinity of the lesson during such lesson, MFH reserves the right to cancel or prematurely conclude such lesson. 


Release of Liability


As an adult student or Parent, I hereby release, indemnify and hold harmless Musicians for Hire, LLC, its member(s), owner(s), directors, managers, employees, contractors and agents (“MFH Parties”) from and against any and all liability, claims, demands and causes of action whatsoever, arising out of or related to any loss, damage, or injury, claim, demand, judgment, action, costs and expenses incurred by MFH arising from any action or inaction occurring from any lesson between MFH and the student and/or parent, where applicable.

Miscellaneous 


Waiver. The waiver of any breach of the Agreement by any party shall not be effective unless in writing, and no such waiver shall constitute the waiver of the same or another breach on a subsequent occasion.


Governing Law; Choice of Forum.  The Agreement shall be governed by and construed in accordance with the internal laws of the State of Maryland.  The parties agree that any appropriate state court located in Frederick County, Maryland or federal court for the District of Maryland, as applicable, shall have exclusive jurisdiction of any case or controversy arising under or in connection with the Agreement and shall be a proper forum in which to adjudicate such case or controversy.  The parties agree that such shall be a proper forum in which to adjudicate such case or controversy and the parties consent to waive any objection to the jurisdiction or venue of such court(s).


Entire Agreement.  The Agreement embodies the entire agreement of the Parties hereto relating to the subject matter hereof and supersedes all oral agreements, and to the extent inconsistent with the terms hereof, all other written agreements. 


Amendment.  The Agreement may not be modified, amended, supplemented or terminated except by a written instrument executed by the Parties hereto.


Severability.  Each of the covenants and agreements hereinabove contained shall be deemed separate, severable and independent covenants, and in the event that any covenant shall be declared invalid by any court of competent jurisdiction, such invalidity shall not in any manner affect or impair the validity or enforceability of any other part or provision of such covenant or of any other covenant contained herein.  Any provision found to be enforceable hereunder shall be replaced with a provision, mutually agreed to by the Parties, which fulfills, to the fullest extent of the law, the original intent of the provision found to be unenforceable.


Captions and Section Headings.  Except as otherwise set forth herein, captions and section headings used herein are for convenience only and are not a part of the Agreement and shall not be used in construing it.
